Operated Hire Booking Terms & Conditions

By placing a booking or accepting a quote, the Hirer agrees to be bound by these Terms and Conditions in full.

1. Definitions

"Company" refers to RMC Cherry Picker Hire. "Hirer" refers to the person, firm, company or public authority hiring equipment or services from the Company. "Equipment" refers to all machinery, vehicles, platforms, tools or accessories hired under this agreement. "Operator" refers to any individual provided by the Company to control or assist in the use of Equipment.

2. Hire Basis

All hires are on an "operated hire" basis only. Equipment is supplied with a trained and IPAF-certified operator. Hirers are not permitted to operate the machines themselves under any circumstances.

3. Hire Period and Charges

  • Travel, delivery, setup, demobilisation, and return may be charged separately.
  • Any overtime beyond the agreed period is charged in full hourly blocks.
  • Pricing may vary by location, duration, and machine type.

4. Booking, Payment and Deposits

  • Full payment is required no later than 48 hours prior to the scheduled start of the booking.
  • Bookings not paid in full by this deadline may be cancelled without notice.
  • A deposit or full upfront payment may be required prior to hire confirmation.
  • Approved account holders must settle invoices within 30 days of issue.
  • Non-payment may result in cancellation of further hires and additional charges.

5. Cancellation Policy

  • 48+ hours before hire: no charge.
  • 24–48 hours: 50% of total hire cost.
  • Less than 24 hours: 100% of hire cost payable.
  • Cancellations after arrival on site are treated as completed hires.

6. Weather Conditions

  • The Company reserves the right to postpone, delay or cancel operations in unsafe weather conditions (e.g., high winds, lightning, ice, flooding).
  • The Operator has full discretion to suspend work if safety is compromised.
  • If the Company cancels due to weather, the hire may be rescheduled within 7 days at no extra cost.
  • If the Hirer cancels due to weather, cancellation fees apply as per Clause 5.

7. Site Conditions and Access

  • The Hirer must ensure clear, level, and safe access to and from the site.
  • The Hirer is responsible for notifying of any restrictions (e.g., permits, traffic management, parking restrictions).
  • Any delays or failed access may result in additional charges.
  • It is the Hirer's sole responsibility to ensure that the selected machine:
    • Can physically access the worksite and fit within the operating area;
    • Is capable of safely reaching the required working height and outreach.
  • Full working diagrams, dimensions, and specifications of each machine are provided by the Company at the quote stage. The Hirer must review and confirm suitability before booking.

8. Use and Responsibility

  • Equipment must only be used under the supervision and control of the Company's operator.
  • Hirers must ensure the work area is clear, safe, and suitable for elevated platform use.
  • Any damage to equipment or third-party property caused by the Hirer's instructions or negligence is the Hirer's responsibility.

9. Operator Conduct

  • Operators will comply with all health and safety standards and follow site instructions within reasonable limits.
  • Operators may refuse to carry out work if they deem it unsafe or outside the agreed scope.

10. Liability and Insurance

  • The Company maintains insurance for its equipment and operators.
  • The Hirer shall maintain appropriate third-party liability insurance to cover risks not assumed by the Company.
  • The Company is not liable for any delays, losses or damages arising from force majeure events, including but not limited to weather, traffic, or equipment failure.

11. Indemnity

The Hirer agrees to indemnify and hold harmless the Company and its staff from any claims, liabilities or damages resulting from the Hirer's negligence, breach of contract, or failure to provide a safe working environment.

12. Termination

The Company may terminate the hire contract immediately if:

  • The Hirer is in breach of any terms.
  • Unsafe site conditions are identified.
  • Non-payment occurs.

13. Governing Law

These Terms and Conditions are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales.

14. Variations

The Company reserves the right to update or modify these Terms and Conditions at any time. Changes will be effective upon publication on the Company's website or inclusion in new contracts.
